Is Pennsylvania A Corruptly-run State?
Josh Hart, Director of Stop Smart Meters in Portola, California, sent out an all-points-email to Pennsylvanians who are battling AMI Smart Meters being forced upon them and their utility services in spite of Act 129 (2008) not mandating them. Â Consequently, no opt-out clause was necessary in the bill (SB220), which was passed and signed into law by then Governor Ed Rendell (D).
Furthermore, Act 129/HB2200 was an Opt-IN bill according to (2) (i) below, as appears published of record in Section 2807(f)7(2):
(2) Â Electric distribution companies shall furnish smart meter technology as follows:
               (i)  Upon request from a customer that agrees to pay
the cost of the smart meter at the time of the request.
               (ii)  In new building construction.
               (iii)  In accordance with a depreciation schedule not
                       to exceed 15 years.
The above bill language appears in the public record in the Pennsylvania House and Senate Journals too! Â However, in the PA Senate Journal of October 8, 2008, PA State Senator Fumo is on record on pages 2626-2631 saying:
“In addition we did not mandate smart meters, but we made them optional.”

Nothing can be clearer about the intent and meaning of HB2200/Act 129 regarding Smart Meters not being mandatory in Pennsylvania!
However, it was the Pennsylvania Public Utility Commission, an administrative agency with no legislative powers, who made Smart Meters mandatory—by law—when they wrote the regulations for utilities to install smart meters.  That action is and was an illegal act called “administrative overreach,” which the PA PUC must be held accountable for and rectified immediately.
Where is the Pennsylvania Attorney General in all of this?
Pennsylvania recently went through a nightmare at the Attorney General’s office in Harrisburg when the previous AG Kathleen Kane was forced to resign in a porn email scandal.
We need similar purging actions to take place at the PA Public Utility Commission, since it’s gone off the rails and made legislation the PA state legislature did not enact.
Numerous Pennsylvanians have been harassed by the PA PUC and various utilities, especially PECO, an Exelon-owned electric distributor, regarding the forcing of AMI Smart Meters, which emit EMF radioactivity and customers/consumers definitely don’t want.
Many customers have gone through the PA PUC Administrative Law Court only to be handed the ruling that there is no opt-out in PA Act 129, so you have to submit to the AMI Smart Meter or get your electricity turned off and disconnected from the grid!
Again, there was NO need for an opt-out clause in HB2200/Act 129 as you can read how the bill/act was published in the public record and Pennsylvanians are being abused and denied their legal rights.
How many utility customers have asked for a Smart Meter and agreed to pay the $300 up front?  Not many I know of!  Not many also know that’s how much they are paying for the Smart Meter, which is an added charge on their monthly utility bills, despite PECO’s getting $200 Million in grant money from the federal government to install Smart Meters!
Getting back to Josh Hart’s email blast about the information PA PUC complainant Laura Sunstein Murphy sent to him, which he emailed to all Pennsylvanians on the Stop Smart Meters networking list, below is what Josh sent around and is of public record now:

PA Act 129: Even though the PA house had added an amendment mandating smart meters early on with the bill, HB 2200, after much discussion (even godshall saying it should not be mandated (!) that was before his son grey was hired by peco), by the time it got to the senate, the senate took out the mandating language, and the house bill adopted the senate version with very little change.
There was NO DISCUSSION in the house reconsideration of the bill as to mandates; the house reconsideration discussion was solely about energy conservation, deregulation of energy suppliers, and that the utilities had to conserve energy because we in PA could not afford new generation plants.
So it was the PUC rulemaking alone which misinterpreted the bill, mandating universal deployment in PA. Â The puc has no authority to make its own rules, and must take its authority solely from the pa lawmaking.
So, here the puc was overreaching in its implementing regulations, obviously being influenced by the utility companies alone, because the puc spoke only to utility companies, and held no public hearings for residential ratepayers, which is us customers.
AND A HUGE THING, the whole act 129 was about saving money and cutting down on electrical demand, and these ami meters soak up 2 watts of power, which WE PAY both PECO and our electricity generation suppliers, so that is a huge waste of electricity, far greater waste of electricity and our pocketbooks.
If you do the calculations as to how much 2 watts of power amounts to in terms of kilowatt hours per month. PECO has 1.7 million customers; we can do the math….especially for the commercial customers who use so much more electricity than homeowners.
sometimes we wonder why this whole smart meter idea hatched, and the answer is, we need to follow the money.
The meter suppliers get money for production, and for amortization because the hardware metes [meters] are fully depreciable over 15 years or less, PECO gets the money to install and maintain the meters from the customers plus the federal stimulus money, PECO sells the zigbee home appliance usage data to third parties for marketing purposes, PECO gets total control over which appliances can run or not run in cases of peak usage, so PECO does not have to maintain much in reserve, and PECO and the electricity generation and gas and water generation suppliers get to charge us for extra electricity usage for running the so called smart meters. What a scam!!

Attorney Sunstein Murphy sets the record straight on the “history” of HB2200.
However, I would like to add there is probable “conflict of interest” on the part of House Consumer Affairs Committee Chairman Robert Godshall (R), whose son Grey works for Exelon/PECO parent company.  See Grey Godshall’s LinkedIn page  before it was taken down.  Chairman Godshall keeps opt-out bills from being called for a vote for over 4 years now!  Why?
I, and many taxpayers in Pennsylvania, think the current PA Attorney General Josh Shapiro (D) must investigate the PA PUC’s “Smart Meter-gate” debacle and agency overreach to get Pennsylvania back to functioning like a law-abiding Commonwealth, not a vested-interests state which has apparent total disregard for the wellbeing of its citizens regarding ENACTED Smart Meter legislation.
January 12, 2017, the Pittsburgh City Paper published “Pa. Attorney.  Let’s take him at his word, since no bigger fraud has been perpetrated against Pennsylvanians than that by the PA PUC, a state administrative agency!
Question: Wasn’t Grey Godshall promoted to EMI installation supervisor immediately after PECO received their $200 million in Stimulus Funds?
